No matter how strong your safety program is, accidents can still happen. As a business owner with a fleet, how you respond after a crash can make a big difference – both for the driver involved and for your company. Below are just a few steps that could be worth following in the event of an accident.
Prioritize safety and medical care first
Think about people first, not property. Is the driver hurt? Are they in a safe location? Ask these questions first so that you can determine whether medical care is needed at the scene. If it’s a fairly serious crash, drivers should always be advised to get checked out, even if they claim to feel no pain. Make sure to check in on a driver’s physical and mental wellbeing in the days and weeks after the incident.
Make sure the right information is collected
Accident scenes are often chaotic and your driver may not remember all the details a few days after. Train your drivers to immediately document information such as names, contact details, insurance information, license plate numbers, DOT numbers (if applicable) and witness information. Photos should also be taken of vehicle damage, road conditions or signage relevant to the accident. To help drivers remember all this, you could create a checklist for them to keep in their glovebox.Â
Notify your insurer promptly
Once the previous steps have been followed, it’s time to notify your insurance carrier – even if the fault is unclear. Some insurers will refuse to pay compensation if they have not been notified of an accident within 48 hours. You don’t have to make a claim straight away, but you should tell your insurer all necessary details. Make sure to also inform any relevant team members like safety managers, HR or operations leads if your insurance policy states this.Â
Understand and comply with regulations
Reporting obligations can apply to certain companies. Review the requirements from the Federal Motor Carrier Safety Administration and your state authorities regarding accident reporting, drug/alcohol testing and incident logs. Make sure these obligations are carried out in good time – if measures need to be carried out immediately, make sure to include this in the post-accident checklist supplied to all drivers.
Preserve evidence and consider legal support
Serious accidents can often become legal cases. Make sure any evidence is preserved – this could include dashcam footage, telematics data, driver qualification records, maintenance records or anything else that might be useful for proving your driver wasn’t at fault or wasn’t acting recklessly. Speaking with legal experts is sometimes recommended. Organizations like the Academy of Truck Accident Attorneys can be a helpful starting point in the case of truck accidents.
Review, learn and improve
After the crisis has passed, take time to step back and review it. Determine whether anything could be done differently and whether training, protocols or maintenance needs to be improved. Learning lessons from accidents can help you to prevent future incidents – or, at the very least, react better to them. By constantly improving, you can build a better safety culture within your company.Â
